Terms and Conditions
1. Amendment To Scope: By signing this agreement, you confirm that the entire scope of work has been agreed upon, and changes may not be able to be made on the day of the job. Any modifications must be coordinated with the estimator, who will issue a change order. You acknowledge that such changes may require a return mobilization, which will be reflected in the change order price. Additionally, you agree that the crew may not be able to accommodate changes on the day of work. If this process delays the commencement of work, an on-site hourly rate will be applied and added to the final invoice.
2. Contract Documentation: Specifications, drawings, and any related documents in this proposal are integral to the contract. The customer is responsible for reviewing and understanding these terms and all associated documents.
3. Payment Terms: Payment is due in full within 30 days of project completion. Late payments incur a 2% monthly fee until fully settled. Non-compliance with payment terms entitles SkyWest Construction Services LLC to collect all amounts earned. SkyWest Construction Services LLC is entitled to reasonable collection and attorney fees, along with other costs incurred in the collection of unpaid balances. Payment methods accepted check, bank transfer, ACH, credit/debit cards, or cash.
4. Deposit Requirement: A deposit may be required for projects valued at $1000.00 or more. Deposit requirements are assessed based on materials and overhead costs associated with the project and must be paid prior to the start of any work.
5. Permits and Fees: The customer is responsible for covering the costs of necessary permits, bonds, and licenses, including any required documentation.
6. Responsibility for Undocumented Utilities: SkyWest Construction Services LLC is not responsible for the damage, repair, replacement, or associated costs of any undocumented, unmarked, improperly marked, abandoned, shallow-buried, or non-to-code utilities, including but not limited to electrical lines, communication lines, irrigation, water, gas, conduit, drainage structures, or any other installations. The client is solely responsible for ensuring all utilities are properly located, marked, and disclosed prior to the commencement of work. Any delays, damages, or costs arising from such conditions shall be the responsibility of the client and may result in additional charges or change orders.
7. Accessibility of Work Area: The project area must be clear of obstructions (e.g., vehicles, dumpsters) at the scheduled start time. SkyWest Construction Services LLC may adjust pricing if any delay or interruption occurs due to such obstructions.
8. Cancellation Policy: SkyWest Construction Services LLC reserves the right to assess a fee for the cancellation of scheduled work. A minimum fee of $100.00 will be applied to the cancellation of any work less than 24 hours from the scheduled start time. Cancellations of scheduled work valued at more than $1000.00 at any time prior to the start of work will be charged a fee equal to 20% total contract value plus the value of any purchased materials. Any deposits paid are also forfeited. If a deposit was collected, it will be applied to the balance of the fee.
9. Cleaning Responsibilities: SkyWest Construction Services LLC is not responsible for cleaning, repairing, or replacing surfaces or areas not directly affected by the work. Responsibility is limited to areas impacted by the project. The client is responsible for the disposal of debris generated by the scope of the project. Materials and debris that has been paid for by the client will not be removed by SkyWest Construction Services LLC unless included on the signed service contract prior to the start of work or is included as signed change order. Requests for off-site debris after completion of work removal will be treated as a separate service.
10. Liability and Indemnity: SkyWest Construction Services LLC agrees to complete work safely and professionally. Once the project is completed and turned over, the customer assumes all responsibility for area maintenance and safety. To the fullest extent permitted by law, the customer agrees to indemnify and hold SkyWest Construction Services LLC harmless from any damages or injuries post-completion.
11. Material & Workmanship Warranty: SkyWest Construction Services LLC guarantees materials and workmanship per specifications for one year from project completion. Changes or deviations from these specifications require a written order and may incur additional charges. Delays due to external factors like weather are not the responsibility of SkyWest Construction Services LLC. Damage or wear caused by negligence or misuse voids this warranty and repairs will be assessed as a standard work request.
12. Use of Project Images and Videos: Customer consents to SkyWest Construction Services LLC’s use of project images or videos for promotional, marketing, and training purposes. SkyWest Construction Services LLC may display customer logos or trademarks if they appear in these materials. Customer consents to getting email marketing from SkyWest Construction Services LLC.
